The “My Life’s Message” Website is intended to facilitate users’ control over their end-of-life wishes by permitting them to create a personal legacy or legacies, assuring that their personal messages are sent to loved ones and other members of their communities following their death, providing a means for them to maintain a centralized record of the location of their financial and other personal information, allowing their Appointed Messengers to communicate notice of their passing to family, friends, and others within their life’s community, and helping them establish with what services, memorials or celebrations they will be remembered (if any). The Website accomplishes these objectives by providing (i) a means to centrally gather information, including the contact information of loved ones and others who will receive an end-of-life notice or personal message, (ii) a vehicle to create personalized messages and notices, including obituaries, (iii) a method to appoint a person or persons responsible for transmitting such notices, and (iv) the facilities to transmit such messages and notices, as well as notices to others such as social media accounts, alumni offices, named professionals, and vendors.

In accessing and using these features and functionality, users contribute both personally identifiable and non-personal information to the Website’s databases. Collection of such data and information by My Life’s Message is essential for the purpose of serving users with functionality described on our Website. My Life’s Message has established this Privacy Policy to explain to users how the information they contribute during and through their use of the Website is protected, collected, used, and disclosed by us. We want our users to be aware of what information is collected and stored by the Website, how it is used, and under what circumstances it may be disclosed to third parties.

By accessing, browsing and/or using the Website, you consent to the collection, retention, use and disclosure of your personally identifiable and non-personal information as stated in this Privacy Policy.

USER LOGIN CREDENTIALS

Each registered user of the “My Life’s Message” website must submit his or her email address, and must create a username and password, when creating an account. Account holders are responsible for maintaining the security and privacy of their own personal login information and must guard against its unauthorized disclosure to others. If you believe your account security has been jeopardized, you must notify My Life’s Message immediately so that your login information can be deactivated promptly. Without such notification, My Life’s Message must assume that communications received under a user’s account and password originated with that user.

PROTECTING YOUR PRIVACY

My Life’s Message takes user privacy concerns very seriously and has taken steps to protect against unwarranted disclosure of both personally identifiable and non-personal user information:

Personally Identifiable Information

Users’ email addresses, login credentials (username and password), voluntarily submitted demographic information and any other information entered into the Website for purposes of accessing and using Website features (including the contact information of family and loved ones, colleagues, friends, and others who are a part of the users’ life community) are stored on the servers/data storage system used by the Website for future retrieval, modification and use. Such servers/data storage system may be provided and maintained by a third party service provider.

Users’ email addresses and login credentials are accessible to My Life’s Message solely for purposes of facilitating user login and customer service purposes. Users’ login credentials may also be accessible by third party service providers that provide such customer service and/or maintain the database(s) wherein those credentials are stored. Such access shall be limited solely as necessary to assist My Life’s Message with providing customer services and updating or removal of user credentials upon user request.

The Website stores data entered by users during the creation of legacies, messages and contact lists solely for those users’ own reference and later transmission by their Appointed Messenger. All user email addresses, login credentials and voluntarily submitted demographic information, along with contact information associated with their account (i.e., the contact information of those persons within the user’s life community who will receive notices/messages), is treated as personally identifiable information and is not shared by the Website with any third parties, except in the limited circumstances identified in this Privacy Policy and the Terms of Use.

We may also collect and use the first and last names and email addresses of the contacts in your address book. We will only collect this information if you initiate to such collection. This information will be used only to make your use of the Website easier to enable your Appointed Messenger to communicate with your contacts at the appointed time. We do not allow unauthorized publishing or disclosure of users’ non-public contacts.

My Life’s Message follows the practices described in this Privacy Policy to secure your personally identifiable information against unauthorized access, use or disclosure. However, users should be aware that no security method is guaranteed to protect information from hackers or human error, including the security features of your computing device, web browser, and Internet Service Provider.

Collection and Use of Non-Personal Information

In addition to the information My Life’s Message treats as personally identifiable, the Website may collect certain non-personal information. Non-personal information is data in a form that does not permit its direct association with any specific individual. In general, My Life’s Message may collect and use non-personal information from users to facilitate those users’ access to and use of the Website and to help My Life’s Message operate and improve the service. The types of non-personal information My Life’s Message may collect and use are as follows:

Web Logs

My Life’s Message may also use “cookies” for internal analytical use, but the data and information collected with cookies is only reviewed in an aggregated form, and is not personally identifiable. My Life’s Message may also collect some non-personal information through formatted links on the Website that help us track whether those links have been followed to third party websites. We do not identify specific users who click on links available on our website.

Demographic Information

My Life’s Message asks users to provide us with certain demographic information to help us understand who our users are, how we can improve our services, and which of our services are most relevant to you. Such requested demographic information may include your age, gender, location, and relationship status, and may change from time to time as we learn more. The contribution of such information by you to My Life’s Message is purely optional and not a requirement of user registration.

Advertising companies are not permitted to collect data through or via the Website for targeted or behavioral marketing of advertisements.

My Life’s Message stores information entered by users in the Website’s database(s), including, without limitation, legacies, messages, obituaries, the contact information of individuals who are to receive communications following users’ deaths, records of the location of documents and financial information, and other personal information submitted by users. All such information shall remain in the My Life’s Message databases for archival and other business purposes (such as to permit the activation of a disabled user account) for a period of one hundred and eighty (180) days following termination of a user account, death of a user, or other event of termination. User account registration information, customer service records, and web logs may be stored indefinitely.

DATA SECURITY

To prevent unauthorized access to the Website’s databases, maintain data accuracy, and ensure the correct use of information supplied by our users, My Life’s Message ensures that physical, technical and administrative safeguards are maintained to protect such information, including, without limitation, fire detection and suppression systems, redundant electrical power systems using Uninterruptible Power Supply units, climate and temperature control systems, and network security using firewalls. We take commercially reasonable and industry standard precautions to protect users from the loss, misuse or alteration of information entered into the Website and your user account.

Although My Life’s Message complies with industry data security standards, and ensures data is stored in a physically secure operating environment that is not available to unauthorized persons, databases and transmissions made via the Internet cannot be fully secure in all instances and we cannot and do not guarantee the complete security of stored data. For this reason, you are discouraged from disclosing any account numbers, passwords or other financial data and information in any messages for intended recipients or Instructions and Records that are retained in the Website database.

LOCATION-BASED SERVICES

The Website does not collect or use location-based information about users such as the real-time geographic location of your computing device.
